An Oregon business man was sentenced to Federal Prison in tax evasion case

On January 29th, 2013, a 66-year old businessman living in Cottage Grove, OR received a one year and one day federal prison sentence after being convicted of filing more than 70 false excise tax forms on behalf of of a local business, Side Pocket Food Company. In addition to the year in prison the businessman must pay back $873,186.88 of restitution to the Tax authorities and serve 300 hours of community service upon release from prison.

[NOTE: The businessman was NOT an officer of the company!] – The government charged the businessman because he was the INDIVIDUAL who signed the tax returns for the business. According to the businessman’s defense attorney two or the businessman’s adult children hold the president and vice president offices for Side Pocket Food Company, and thought the father was not an owner or an officer, he attested to the factual integrity of the tax documents that he personally signed.

At 66, and not an owner or officer, ho can this businessman pay the almost 1 million dollars of restitution? His attorney commented: “The fact that [my client] has been required to pay what he can under restitution as part of a criminal sentence doesn’t prevent the Tax Authority from also looking to the business… I expect that they will want my client to pay what he can and they will want the company to pay what it can.”
